AL JUZGADO
Don/Doña [Nombre del demandante], mayor de edad, con DNI número [Número de DNI], con domicilio en [Dirección del demandante], ante el Juzgado comparezco y como mejor proceda en Derecho, DIGO:
Que por medio del presente escrito formulo DEMANDA DE LESIONES contra Don/Doña [Nombre del ciclista], mayor de edad, con DNI número [Número de DNI del ciclista], con domicilio en [Dirección del ciclista], y contra la empresa [Nombre de la empresa de reparto de comida], con CIF [CIF de la empresa], y domicilio en [Dirección de la empresa], en base a los siguientes,
HECHOS
- Que el día [Fecha del accidente], en la calle [Nombre de la calle], Don/Doña [Nombre del ciclista], trabajador de la empresa [Nombre de la empresa de reparto de comida], atropelló a Don/Doña [Nombre del demandante] mientras realizaba su labor de reparto de comida en bicicleta.
- Como consecuencia del atropello, Don/Doña [Nombre del demandante] sufrió lesiones [Describir las lesiones], que requirieron atención médica y tratamiento [Describir el tratamiento médico si es relevante].
- Que Don/Doña [Nombre del demandante] ha sufrido daños personales y materiales como consecuencia del accidente, de acuerdo con el Artículo 129 del Texto refundido de la Ley General para la Defensa de los Consumidores y Usuarios.
FUNDAMENTOS DE DERECHO
- COMPETENCIA Y JURISDICCIÓN: Corresponde a este Juzgado conocer del presente procedimiento de conformidad con lo dispuesto en el artículo 52.1.u) de la Ley de Enjuiciamiento Civil.
- PROCEDIMIENTO: El procedimiento adecuado para el presente caso es el juicio verbal, de acuerdo con lo establecido en el artículo 250.2 de la Ley de Enjuiciamiento Civil.
III. RESPONSABILIDAD: De acuerdo con el?Artículo 135 del Texto refundido de la Ley General para la Defensa de los Consumidores y Usuarios, los productores son responsables de los daños causados por los defectos de los productos que, respectivamente, fabriquen o importen.
- INDEMNIZACIÓN: Según el?Artículo 134 del Texto refundido de la Ley General para la Defensa de los Consumidores y Usuarios, el beneficiario de las indemnizaciones tiene derecho a una compensación por los daños contractuales y extracontractuales durante el tiempo que transcurra desde la declaración judicial de responsabilidad hasta su pago efectivo.
Por todo lo expuesto,
SOLICITO AL JUZGADO: Que tenga por presentado este escrito y sus copias, se sirva admitirlo, y en sus méritos, se dicte en su día sentencia por la que se condene a Don/Doña [Nombre del ciclista] y a la empresa [Nombre de la empresa de reparto de comida] a indemnizar a Don/Doña [Nombre del demandante] en la cantidad que se determine por los daños y perjuicios sufridos, más los intereses legales correspondientes desde la fecha del accidente y las costas procesales.
